This website is owned by Hobbito. This Privacy Policy (hereinafter referred to as “Policy”) concerns the processing by Hobbito of the personal data you provide to it and it collects, stores, uses, discloses and generally processes when you visit or use this website and the web/mobile application Hobbito (hereinafter collectively referred to as “Hobbito”). This Policy also describes how we protect your personal data, the rights you have in relation to your personal data, and how you can contact us.

Your explicit agreement to the terms of this Policy is deemed to be a careful reading, understanding and freely declaring your consent to the collection, use and onward transmission of your personal data for purposes related to the use of Hobbito as set out below.

(hereinafter referred to as “Hobbito” or “we” or “us”). SCOPE OF APPLICATION OF THE PRIVACY POLICY

The protection of your personal data is very important to us.

This Policy establishes the measures we have taken in relation to the personal data we collect from you and/or through the Website, in accordance with the General Data Protection Regulation 2016/679/EU (GDPR), as supplemented by the relevant national and European legislation on the protection of personal data. For the purposes of this Privacy Policy the following definitions shall apply: The term “personal data” (or “Data”) refers to any kind of information that identifies you. Such information can be the name, last name, contact details, address, email. In this context, it is important to inform you on how and by what means we use the information we collect. The term “sensitive personal data” refers to any kind of information revealing racial or ethnic origins, political opinions, religious or philosophical beliefs or trade-union status, as well as personal information on genetic data, biometric data uniquely identifying a natural person, health data or data concerning a natural person's sex life and sexual orientation. The term “processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, registration, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, association or combination, restriction, deletion or destruction.

WHAT DATA DO WE COLLECT AND FOR WHAT PURPOSES WE PROCESS THEM - LEGAL BASIS OF PROCESSING

We take care to collect only strictly necessary Data, which are appropriate and clear for the purpose intended.

Please note that whenever we ask you to fill in your personal data in order to access any Hobbito application operation or service, we will note certain fields as mandatory, as this is the basic information we need to be able to provide you with the service. Please be advised that if you do not disclose these data to us, you may not be able to complete your registration or benefit from the relevant services.

Depending on how you interact with Hobbito Application, we will process your personal data for the following purposes:

To manage your registration as a Hobbito User

If you decide to become a registered user of our Application, we need to process your data to identify you as a user of the Application and to secure your access to it as a registered User. You can cancel this account by choosing to delete your account. In this case, the Application remains installed on your mobile, but in order to use it you must re-register.

For the registration of a User in Hobbito the following personal data will be requested and processed in accordance with Article 6 (1) (b) of the General Data Protection Regulation (GDPR) for the purpose of the execution of the contract:

-First Name – Last Name - Email Address – User Password.

All details are mandatory, without the registration of which it is not possible to complete the User's registration.

Profile Creation

Each registered User by registering in the Application automatically acquires a Profile, which can be edited at any time (e.g. to change the email address or User Password), and to which they can optionally enter the following additional data, which can be deleted at any time:

- Age – Photo – Mobile Phone - favorite activities.

All these details, with the exception of the phone number, are available to other Users when they visit the Profile of the specific User who has already registered a proposal to conduct an activity.

As long as a User does not register any or all of the optional data, their Profile only displays their First Name and Last Name.

For the creation/editing and maintenance of a User's Profile in Hobbito, the above personal data already registered by the User shall be processed in accordance with Article 6 (1) (b) of the General Data Protection Regulation (GDPR) for the purpose of the execution of the contract.

Using the Application

Login to the Application

In order to identify the User when logging in to the Application, the following personal data will be processed in accordance with Article 6 (1) (b) of the General Data Protection Regulation (GDPR) for the purpose of the execution of the contract:

- User Password (in encrypted form) - Email

After the User's login, they may communicate via chat with other Users, follow another User, see the proposals for the conduct of a specific game/activity submitted by other Users and/or create a proposal themselves. They can also visit the Profiles of other Users and evaluate them, as well as communicate directly with another User through the Chat. In details:

Organization of games/activities and participation in them - communication between Users - evaluation of Users and in general use of the services of the Hobbito Application

Hobbito Application has a variety of categories of activities (sports, such as tennis, basketball, football, etc., and other activities-hobbies in general, such as chess).

Each User, by selecting the category of activity they are interested in, may make a new proposal for a specific game/activity in this category (the “Administrator-User”), by entering the necessary details, i.e. the venue, the date (s) and the exact time (s) of the proposed conduct, in which case any other User may then submit a request to participate in an already registered game/activity proposal, until the specified number of persons who may participate in the specific activity is reached. The Administrator-User decides whether or not to accept another User's participation request.

There is no limitation on the number of proposals that the same User can register/participate.

Each User can also provide feedback on their experience of a particular game/activity by evaluating their partner (s) (other Users) publicly through the Hobbito Application. These comments remain in the User's Profile for the last ten (10) games.

Any User who wishes to edit /sign up to a game/ activity proposal registered by another User in the Application, for the purpose of identifying their potential teammate-partner and participating in the proposal, has the opportunity to visit the Profile of the Administrator-User. The information to which the User thus gains access includes (a) on the one hand the personal data that the User themselves have entered in their Profile (with the exception of their mobile phone number) such as the Name and initial letter from their last name - Age - favorite activities) the number of Users they follow and that follows them), and (b) information provided by the Application based on the data that the Users enter for each game-activity that has been conducted, i.e. the scoring/ ranking and level of the User per activity, defeats and wins per activity, as well as comments that other Users have registered in accordance with the previous paragraph.

Also, if a User has been accepted by the Administrator-User, they may visit the Profiles of the other Users who have already signed up to the specific game/activity proposal.

Also, each User has the option to follow other Users or to contact them directly by visiting their Profile.

Users who have been accepted by the Administrator-User for a specific game, can communicate with each other via a group chat organized by the Administrator-User for this game.

In the context of all the above services provided by the Application, the following personal data will be processed in accordance with Article 6 (1) (b) of the General Data Protection Regulation (GDPR) for the purpose of the execution of the contract:

- User Password - User identifier that they are logged in to the Application

- the following data from the Profile of the User who has submitted a proposal or participation in a game/activity proposal:

- First name – initial letter from the Last Name - Email address

- Age - Photo - favorite activities (if registered by the User themselves)

- the number of Users that they follow and that follow them, and

- scoring/ ranking and the level of the User per activity - defeats and wins per activity based on the last 10 games, as well as comments registered by other Users in accordance with the previous paragraph.

Newsletters receipt

You will be able to receive newsletters sent electronically (e-mail) to your terminal equipment (smartphone, tablet, PC, etc.) if you have agreed to receive news during your registration as a User on the mailing lists of Hobbito newsletters.

In this context, we will process the following personal data based on your consent in accordance with Article 6 (1) (a) of the General Data Protection Regulation (GDPR):

- Email.

Sending a Contact Form

For the electronic communication of the Users with Hobbito, the relevant contact form must be filled in and submitted. In this context, we will process the following personal data based on your consent in accordance with Article 6 (1) (a) of the General Data Protection Regulation (GDPR):

- Email - First name – Last name.

Sending a Contact Form to interested parties to be advertised

For the electronic communication of interested parties to be advertised through Hobbito, the relevant contact form must be filled in and submitted. In this context, we will process the following personal data based on your consent in accordance with Article 6 (1) (a) of the General Data Protection Regulation (GDPR):

-Name - Last Name- Email – Company – Phone

Compliance with our obligations

Finally, we process all personal data available to us from your registration and use of the Hobbito Application in accordance with Article 6(1.)(c) of the General Data Protection Regulation (GDPR), as required for compliance with our obligations arising from the Law (e.g. tax legislation, e-commerce legislation, etc.).

Navigation Data

When the User has access to Hobbito, we automatically collect activity information (navigation data) about the User's navigation on the Website, such as the IP address of the User, the domain name of the User, location and country, information about the operating system and the User's browser, including the IP address, the type of the User's Internet browser, as well as information about the computer software or hardware. If the User has access to Hobbito from a mobile phone or other device, we can collect a unique identifier assigned to this device.

We may also collect information about the websites visited by the User within Hobbito, access time to Hobbito, navigation time to each website, clickstream analysis. Although Hobbito does not collect the above information in order to link it to specific users, it is nevertheless possible to identify the users either directly through the above information or by using other information collected.

Cookies

Like all websites and applications, Hobbito uses cookies which are small text files that may be sent by websites visited by the User and are registered on the User's computer/mobile phone, in order to be resent to those same websites when the User revisits them. MANNER OF PROCESSING

The Data may be processed on paper, by automated or electronic means including mail or e-mail, telephone (e.g. automated calls, SMS, MMS), fax and any other means (e.g. websites, mobile applications).

DATA RECIPIENTS - TRANSFER OF DATA OUTSIDE THE EU AND THE EEA

Access to Data within Hobbito is limited to those who “need to know” for the above processing purposes. As a rule, we do not transfer your Data to third parties. Exceptionally:

Processors – transmission within and outside the EU and EEA

Access to Data have natural and/or legal persons acting on your behalf as the processors in accordance with specific contractual obligations, and are based in EU Member States. These persons process the Data on behalf of you in accordance with the mandates, the hosting provider of Hobbito and in particular the company [Webalists] and providers of marketing services or software and communication tools that help them promote its services and products and facilitate communication with you.

In order to inform them according to the purpose of the communication you have stated, we may transfer part of the Data to (e-mail – Name – Last Name) outside the EU and more specifically to the US through technological platforms located there. The platforms/companies we currently work with are MailChimp which we use for Hobbito newsletters. MailChimp is contractually bound to transfer and process all European data of its users in accordance with the Standard Contractual Clauses (the “SCCs”) provided for in the GDPR, having already adopted the new SCCs approved by the European Committee on 4 June 2021.

Advertisers

We only provide advertisers with information about the number of Users who viewed their ads without any data identifying Users.

Data may be communicated under our legal obligations to third parties for compliance with our legal obligations, execution of orders from public, judicial and administrative authorities, such as regulators, law enforcement services, or exercise our rights before the competent judicial authorities.

DURATION OF DATA RETENTION

All Data are kept for a predetermined and limited period depending on the purpose of processing, at the end of which, such Data are deleted from the Hobbito databases unless an extension of this period of time is required due to legal claims or legal obligations of Hobbito.

Information – communication

The Data processed by Hobbito based on your consent, i.e. for receiving newsletters and communicating with us, as well as for any other purpose you explicitly provide your consent in accordance with this Policy, is kept from the moment you provide your consent until the moment you withdraw your consent. If you withdraw your consent, the Data will no longer be used for the above purposes, however they may continue to be kept by Hobbito in particular as required for the protection of its interests related to possible liability in relation to this processing, unless further clarifications are provided by the competent Supervisory Authority.

Registration and Use of Hobbito Application

User Account Data are retained for as long as the User account is active, unless a new processing purpose has arisen for any of them.

In any case, the Data is kept for as long as it is further required until the limitation of relevant claims occurs and for as long as required by tax legislation, the applicable legal and regulatory framework or for the duration that a court case is pending in relation to them.

Improving functionality – protecting our interests

The Data that are processed as to enable the elimination of malfunctions in the Hobbito Application, and in general to control and improve the Application, are kept for as long as necessary to fulfill this purpose.

Data collected through Cookies

In particular, the Data regarding the improvement of the User's experience in Hobbito collected through the Cookies will be kept for the periods specified in the Company's Cookie Policy [link].

DATA PROTECTION

To prevent unauthorized access, maintain the accuracy of the Data and ensure the appropriate use of your Data, we have taken all appropriate organizational and technical measures to ensure the security and protection of your Data from any unauthorized access, improper use, alteration, unauthorized disclosure, loss or accidental/ unlawful destruction and any other form of unlawful processing. These measures shall be reviewed and amended whenever deemed necessary. However, no method of transmission over the Internet or method of electronic storage is 100% secure. Hobbito has taken reasonable precautions to obtain the personal information available through the online community.

USE OF AUTOMATED DECISION MAKING - PROFILING DURING DATA PROCESSING

Hobbito does not make decisions based on automated processing of your Data, except in the case of the use of cookies in Hobbito, always upon informing you and obtaining your consent.

WHAT ARE YOUR RIGHTS

You have the right to access your Data

This means that you have the right to be informed by us how and which of your Data we process and to request copies of them.

You have the right to edit inaccurate personal Data.

If you find that there is an error in your Data you can submit an application to us to correct them (e.g. name correction or email address change update), and also you can correct them from your profile page

You have the right to deletion.

You can ask us to delete your Data if it is no longer necessary for the aforementioned processing purposes.

You have the right of Data portability.

You may ask us to receive in a structured, commonly used and machine-readable format, the Data you have provided or ask us to transmit them to another controller.

You have the right to limit the processing.

You may ask us to limit the processing of your Data for as long as the review of your objections regarding the processing is pending.

You have the right to revoke/oppose to the processing of your Data.

You may object to the processing of your Data or withdraw your consent, where required and we will stop the processing of your Data, if there are no other compelling and legitimate reasons that prevail over your right or if they are no longer necessary for the aforementioned processing purposes.

You have the right to lodge a complaint in the event of unlawful processing of Data

You can lodge a relevant complaint before the Supervisory Authority for the Protection of Personal Data (Data Protection Authority) (www.dpa.gr), 1-3 Kifissias Avenue, tel. +30 210 6475000.

HOW TO EXERCISE YOUR RIGHTS

You can exercise your rights by writing to the postal address of Hobbito (SMIRNIS Street, P.C. 12242, Athens), or at the following e-mail: [email protected].

We reply to your Requests free of charge without delay, and in any case within (1) one month after we receive your request. However, if your request is complex or there is a large number of requests we will inform you within the month whether we need to receive an extension of another (2) two months within which we will reply to you or ask you to cover the relevant costs.

APPLICABLE LAW

The Applicable Law is the Greek Law, as amended in accordance with the General Data Protection Regulation 2016/679/EU and L. 4624/2019, and in general the current national and European legislative and regulatory framework for the protection of personal data.

The Courts of Athens are competent for any disputes concerning your Data.

AMENDMENTS

We update this Policy whenever necessary. In any case, we reserve the right to modify the Policy in whole or in part or to simply update its content (e.g. as a result of amendments to applicable law). If there are significant changes in the Policy or in the way we use your Data, we will publish on our website an update of this, before the changes take effect. We encourage you to read this Policy at regular intervals as to be aware on how your Data are protected. This Policy entered into force on 25-06-2022.
